1.  Definitions

 

    a.  =93Agreement to Extend = Enlistment=94 refers=20 to the official form of agreement, NAVPERS 1070/621 (Rev. 1-00), = Agreement to=20 Extend Enlistment (MILPERSMAN 1070-250). =20 Service record copy should be filed as page 1A.  Agreements on other than the = official=20 form are of an informal, unofficial nature, and could be repudiated or = withdrawn=20 by the member.  Clerical=20 instructions for preparation of the agreement are contained in reference = (a).

 

    b.  =93Agreement to Extend = Active=20 Duty=94 refers to the official form of agreement, NAVPERS = 1070/622=20 (Rev. 1-00), Agreement to Recall or Extend Active Duty (MILPERSMAN=20 1070-260).  Service record = copy=20 should be filed as page 1B.  = For=20 USNR members, NAVPERS 1070/622 is used to extend the Reserve Active Duty = Obligation (RADO) and NAVPERS 1070/621 to extend the Enlisted Reserve = Enlistment=20 (EREN), if required.  = Clerical=20 instructions for preparation of this document are contained in reference = (a).

 

    c.  =93Execution of the Agreement to = Extend=20 Enlistment=94 or =93execution of=20 extension=94 refers to the signature of an agreement by the member=20 concerned.

 

    d.  =93Extension becomes = operative=94 or =93operative date=94 refers to = the date the=20 extension begins to run, that is, the date of expiration of enlistment, = or as=20 extended, or as adjusted for the purpose of making up time not = served.  Extension agreements may not = be canceled=20 after the operative date.

 

    e.  =93Conditional=94 extensions are = executed as=20 prescribed below and are for periods of 23 months or = less.

 

    f.  =93Unconditional=94 extensions = are executed=20 as prescribed below and are for periods of 24 months or = more.

 

2.  Ineligibility for=20 Extension

 

    a.  Members who are not eligible = for=20 reenlistment for any reason may not extend their enlistments without = prior=20 approval of Navy Personnel Command (NAVPERSCOM), Enlisted Performance = and=20 Separations Branch (PERS-832).

 

    b.  At no time may an extension of = enlistment be executed for the purpose of extending an enlistment, or = enlistment=20 as extended, which has already expired. =20 (For conditional reenlistments, see MILPERSMAN = 1160-030.)

 

    c.  Members in receipt of an = authorization=20 for transfer to the Fleet Reserve may not extend their enlistment = more=20 than 30 days beyond their high year tenure (HYT) or approved=20 Fleet Reserve date (whichever is less), without specific approval = of=20 NAVPERSCOM, Enlisted Retirement Branch (PERS-823).  Extension of enlistment = subsequent to=20 transfer to the Fleet Reserve is not appropriate since members in the = Fleet=20 Reserve do not serve under an enlistment contract.

 

3.  Extension = Increments.  Extensions shall be executed = in=20 increments of 1 or more months not to exceed an aggregate of = 48 months on=20 any single enlistment.  = The 48-month=20 limitation on extension of enlistment is statutory (reference (b)) and = cannot be=20 waived.

 

4.  Conditional = Extensions.  Conditional extensions may be = executed=20 regardless of remaining obligated service (OBLISERV) for the following = reasons=20 only, or as directed by NAVPERSCOM:

 

    a.  To obtain maternity care = benefits for=20 a member=92s wife.  = A=20 member whose normal expiration of active obligated service (EAOS) falls = within=20 the wife=92s pregnancy may execute an extension in order to receive = maternity=20 benefits, provided the member=92s services can be used effectively = during the=20 period of extension.  The = executed=20 extension shall not exceed the spouse=92s estimated delivery date plus 2 = months.  An agreement for = this=20 reason shall not be executed after transfer to a separation=20 activity.

 

    b.  To obtain maternity care = benefits for=20 a pregnant servicewoman whose normal EAOS falls within her pregnancy or=20 postnatal period.  An = extension=20 of up to 1 year may be granted in order to receive maternity benefits, = provided=20 the member=92s performance has been satisfactory.  An agreement for this reason = shall not=20 be executed after transfer to a separation activity.  For the purpose of this = extension, the=20 postnatal period covers the 2 months following the birth.  Extensions authorized for this = reason=20 may be in addition to other extensions, provided the maximum 48 months = allowed=20 on one enlistment is not exceeded. =20 Unusual cases may be referred to NAVPERSCOM, Enlisted Career = Progression=20 Division (Pers-81).

 

    c.  To complete a scheduled = cruise or=20 deployment, provided the member=92s relief is not on board or = en route=20 and a projected rotation date (PRD) adjustment has been authorized = by the=20 appropriate assignment control authority (ACA).

 

    d.  To adjust the EAOS date of = a member=20 serving on any tour of duty to coincide with the established=20 PRD.

 

    e.  To obtain OBLISERV required = to=20 execute permanent change of station (PCS) orders.  Two extensions are authorized = if=20 obtainment of OBLISERV by reenlistment or one single extension of = enlistment=20 will result in possible loss of selective reenlistment bonus = (SRB)/enlistment=20 bonus (EB) entitlement. =20 For example, if a servicemember is in receipt of orders with = a SRB=20 qualifying Navy Enlisted Classification (NEC) school in route to the = final=20 destination, and does not qualify under the OBLISERV to Train (OTT) = program (see=20 most recent SRB NAVADMIN message), the member may execute one extension = to=20 complete the school and a second extension to meet the total required = OBLISERV=20 on member=92s orders.  See = MILPERSMAN=20 1306-106 for information about OBLISERV in connection with a PCS=20 transfer.

 

    f.  To acquire necessary = OBLISERV as=20 authorized in certain Navy directives and this manual.  For example, extension to = OBLISERV for=20 Fleet Reserve, or to the extent of HYT allowed.  Agreements to extend an = enlistment to=20 qualify or apply for a specific program are not authorized. 

 

    g.  Perform to Serve (PTS) = candidates=20 may be extended for up to 2 months (or as published in latest PTS = NAVADMIN) to=20 await PTS results.

 

    h.  For members with an = approved Physical=20 Fitness Assessment (PFA) Progress or Readiness waiver for ADSEP = processing per=20 reference (c).  If = member fails=20 official PFA while on enlistment extension, member shall be processed = for=20 administrative separation (ADSEP) within 45 days of PFA=20 failure.

 

    i.  Qualified for Tuition Assistance = (TA) or=20 Navy College Program Afloat (NCPACE). =20 Enlisted Sailors under 19 years time in service, who are = otherwise fully=20 qualified for TA or NCPACE, may execute a one-time conditional extension = per=20 enlistment contract for the purpose of continuing their education.  The extension must be long = enough to=20 cover the 1-year time in service requirement, and will be subsequent to = any=20 existing extension.  = Executing this=20 one-time extension does not automatically preclude a Sailor from = receiving a=20 Selective Reenlistment Bonus (SRB); however, it will affect the = Sailor=92s SRB=20 eligibility and/or amount if it becomes operative.  Conditional extensions for SRB = eligible=20 Sailors must be approved by NAVPERSCOM, Active Career Progression Branch = (PERS-811).  Commanding=20 officers(COs)/officers in charge (OICs) are authorized to approve all=20 others.  All Sailors who = require a=20 High Year Tenure (HYT) waiver in order to sign a conditional extension, = which=20 exceeds the HYT for their grade, must obtain approval from NAVPERSCOM = (PERS-823)=20 prior to the CO/OIC approving the conditional extension.  NAVPERS 1306/7 = (Rev.1‑03), Enlisted=20 Personnel Action Request, requesting HYT waiver must be endorsed by = the=20 CO/OIC.

 

5.  Unconditional = Extensions.  Unconditional extensions may = be executed=20 to extend enlistment up to a maximum of 48 months (not to exceed = total=20 aggregate of 48 months per enlistment).  Unconditional extensions for = less=20 than 24 months are not authorized.

 

6.  Procedure for Executing=20 Extension

 

    a.  To execute an extension, = NAVPERS=20 1070/621 (or automated equivalent) shall be completed and signed on, or = prior=20 to, the date of expiration of enlistment by the member and an = official=20 authorized in this manual to accept the agreement on behalf of the=20 Navy.  Agreements entered = into=20 subsequent to the date of expiration of enlistment are without = legal force=20 and effect.

 

        = (1)=20 Conditional agreements to = extend may=20 be executed at any time during the enlistment.  The narrative reason for the = extension=20 will be entered on NAVPERS 1070/621 or NAVPERS 1070/622.

 

        = (2)=20 Unconditional agreements = to extend=20 enlistment may be executed at any time during an enlistment.  The following reason for = extension and=20 statement of understanding shall be entered on NAVPERS = 1070/621:

 

=93To continue career. =20 I understand that this extension becomes binding upon execution = and may=20 not be thereafter canceled, except as provided in MILPERSMAN = 1160-040.=94

 

    b.  Before the execution of an = unconditional=20 or conditional extension of enlistment, the member shall be made aware = of=20 potential loss of monetary benefits and the provisions of the SRB = program per=20 reference (d).  The = following entry=20 shall be included on NAVPERS 1070/621 or NAVPERS 1070/622 under the = reason for=20 extension:

 

=93I have been informed of the provisions of the = SRB program=20 and the execution of this extension of = enlistment=20 may affect my entitlement to monetary benefits for a subsequent=20 reenlistment.=94

 

7.  Physical = Examination. =20 Qualification for continued active duty service should be based = on the=20 ability of a service member to perform the functions of his or her rate, = rank,=20 or occupational specialty without physical or medical limitations.  Per chapter 15 of reference = (e), routine=20 periodic physical examinations are no longer required for active duty=20 personnel.  Instead, the = use of the=20 Periodic Health Assessment, with guidance provided in reference (f), = should be=20 used to meet this goal.

 

8.  Canceling an Extension=20 Agreement

 

    a.  An extension agreement is = canceled by=20 completing the appropriate portion of the agreement. 

 

    b.  A valid extension of = enlistment that=20 has become operative is normally not canceled.  When a number of = extensions within=20 the current enlistment were executed and the inappropriate extension = becomes=20 operative (for example a 3-month extension for school vice the 6-month = to=20 complete deployment), refer the case to NAVPERSCOM (PERS-811) for system = correction.

 

    c.  COs shall cancel agreements = to extend=20 enlistment, prior to operative date, for reasons listed=20 below.  Copies of = appropriate=20

 

=B7       =20 NAVPERS=20 1070/604 (Rev. 3-05), Enlisted Qualifications = History;

=B7       =20 NAVPERS=20 1070/613 (Rev. 7-06), Administrative Remarks; NAVPERS 1070/621 = (Rev. 1-00),=20 Agreement to Extend Enlistment; and

=B7       =20 NAVCRUIT=20 1133/52, Enlistment Guarantees (if applicable)

 

must be = forwarded=20 where cancellation consideration is requested.

 

        = (1)=20 When member is on unauthorized absence, whose EAOS would otherwise = expire=20 (unless the CO considers their intention to absent themselves was = for the=20 purpose of abrogating the agreement).

 

        = (2)=20 When closing a member=92s record because of desertion.

 

        = (3)=20 Except as provided below, when members, through no fault of their own, = have not=20 received any of the benefits (i.e., schools, accelerated = advancement, PCS=20 move, or EB) for which the extension was executed by the day preceding = the=20 operative date of the extension.  = Members whose extensions are canceled by the above who desire to = continue=20 on active duty may simultaneously execute a new extension or reenlist = per=20 appropriate articles in this manual, notwithstanding the time limits=20 specified.

 

        = (4)=20 When appropriate, when a member is disenrolled from a specialized course = of=20 instruction (or as addressed in paragraph 10 below), prior to the class=20 convening date, cite this article as cancellation or re-execution=20 authority.

 

        = (5)=20 When a member reenlists.  = The=20 extension(s) shall be canceled as of the date of reenlistment, = provided=20 term of the new enlistment exceeds the total aggregate months of = extension(s) to=20 be cancelled.

 

        = (6)=20 When the member is no longer recommended for reenlistment either because = of=20 failure to meet the minimum reenlistment standards set forth in this = manual and=20 reference (g), or unsatisfactory performance of duty or conduct, = and in the=20 opinion of the CO, the member lacks career potential.  A full statement of the = facts shall=20 be included in the NAVPERS 1070/613 service record entry with notation = that=20 member is not recommended for reenlistment.  The CO will cancel extensions = under this=20 paragraph only when the extension required resulted in no significant = benefits=20 to the member.

 

        = (7)=20 When a member fails to meet PFA standards three or more times in the = most recent=20 4-year period, any inoperative extensions shall be cancelled.  For members with an approved=20 PFA Progress or Readiness waiver for ADSEP processing per reference = (c),=20 they may request extensions in 6-month increments, at the CO=92s level=20 approval.  Only those = personnel who=20 have shown progress as defined in reference (c) and have the potential = of=20 passing the next PFA shall be considered for this type of = extension.  The limit of extension to an = aggregate=20 of 48 months in any single enlistment remains in effect.  Failure of PFA during = extension period=20 shall prevent additional extension and result in discharge at EAOS. =

 

    d.  A request or recommendation = for=20 cancellation of an agreement to extend enlistment that appears = meritorious=20 (i.e., significant benefit resulted from the extension such as 6-year = obligator=20 program, accompanied overseas tour, or advancement), but is not = authorized=20 above shall be forwarded to NAVPERSCOM (PERS‑811) for = determination provided=20 that the extension has not become operative.

 

9.  Criteria for not Canceling = Agreements to=20 Extension

 

    a.  COs will not cancel an agreement to = extend=20 enlistment under the following conditions:

 

        = (1)=20 Member is found to be not physically qualified and/or limited duty = (LIMDU) is=20 anticipated.

 

        = (2)=20 A member is currently on LIMDU (ACC 105), provided member is physically=20 qualified in all respects with exception of the diagnosis in the basic = medical=20 board report.

 

        = (3)=20 A member is to be referred to a physical evaluation board (PEB) for = disability=20 proceedings and benefits resulted from the extension.

 

        = (4)=20 Benefits have been received under the EB program or accelerated = advancement has=20 occurred.

 

    b.  When a member is currently = on LIMDU=20 or is found not physically qualified for duty at the expiration of=20 enlistment, an extension agreement cannot be executed.  In these circumstances, = members will be=20 retained in the Naval Service beyond the expiration of enlistment via an = involuntary extension (see reference (h) for the Military Pay = event).  Suitability and all other = eligibility=20 must be maintained.  = Documentation=20 will be made on NAVPERS 1070/613 in either case.  NOTE:  If upon completion of LIMDU = and return=20 to full duty (ACC 100), the member is still on an expired EAOS then = she/he must=20 either reenlist or separate. =20 Further extension of current enlistment is not an option, since = the=20 enlistment (or extended enlistment) already expired.  If conditional reenlistment = warrants=20 (i.e., HYT), refer to MILPERSMAN 1160-030 or refer the case to = NAVPERSCOM=20 (PERS‑811).  =

 

10.  Agreement to Extend = Enlistment=20 and/or Active Duty Agreement Executed to Obtain a Course of=20 Instruction

 

    a.  Guidelines.  Specific selection = requirements for=20 various schools are published by NAVPERSCOM in manuals and directives = issued to=20 responsible commands.  = Members=20 selected for assignment to schools must be qualified under these = selection=20 requirements.

 

    b.  Qualifications

 

        = (1)=20 Candidates selected must be enlisted members on active duty and must = have the=20 OBLISERV as required under applicable provisions of MILPERSMAN 1306-604 = or=20 directives pertaining to the school for which the member is=20 applying.

 

        = (2)=20 Members having less than the required OBLISERV, but who are in all other = respects qualified, who desire and are selected for training in a course = of=20 instruction, shall execute NAVPERS 1070/621 and/or NAVPERS 1070/622 or = Navy=20 Standard Integrated Personnel System (NSIPS) equivalent.

 

        = (3)=20 Members who accepted Accelerated Advancement and/or EB shall not have = their=20 Extension of Enlistment/Active Duty cancelled nor are they eligible = under the=20 Payback policy.

    c.  Payback for Disenrolled=20 Members

 

        = (1)=20 Members who are disenrolled from

 

=B7       =20 Service=20 Schools A, C, and F;

=B7       =20 Special=20 Programs Nuclear Field (NF), Advanced Electronic Field (AEF), and = Advanced=20 Technical Field (ATF) 6-Year Obligor Programs); or =

=B7       =20 5-Year=20 Obligor Programs, for which OBLISERV was acquired in the form of a = NAVPERS=20 1070/621 and/or a NAVPERS 1070/622 entry;

 

shall = have their=20 OBLISERV adjusted under this article, provided they have not accepted=20 accelerated advancement.  = Such=20 adjustment hereafter will be referred to as payback.  See below for details of = payback for=20 specific courses of instruction.

 

        = (2)=20 Exemption:  Members = who=20 entered into extension agreements that do not contain one of the = following=20 clauses, continue to be eligible for payback under this = article:

 

           =20 (a) =93In particular I understand that when I accept = accelerated=20 advancement to E-4 this agreement may not be cancelled whether or not I = accept=20 nuclear power or advanced training.=94

 

           =20 (b) =93I understand this extension becomes binding upon = execution and=20 thereafter may not be cancelled whether or not I complete nuclear power = or=20 advanced training.=94

 

           =20 (c) =93In particular I understand that when I accept = accelerated=20 advancement to E-4 this agreement may not be cancelled whether or not I = complete=20 advanced training.=94

 

           =20 (d) =93In particular I understand that when I accept = accelerated=20 advancement to E-4 this agreement may not be cancelled whether or not I = complete=20 nuclear power training.=94

 

d. =20 Payback for Service = Schools=20 A, C, and F.  Payback should be computed per = the table=20 contained in paragraph 10j below, if an active duty or extension = agreement was=20 required to qualify for any of the above training.

 

    e.  Payback for Special Programs NF, = AEF, and=20 ATF 6-Year Obligor Programs) Prior to Advanced=20 Training

 

        = (1)=20 If a member is disenrolled from a 6-Year Obligor Program for any reason = prior to=20 entry into the advanced training phase as defined below, the member may = send a=20 request to NAVPERSCOM (PERS-811) for cancellation of an agreement to = extend=20 enlistment and/or active duty agreement. =20 To facilitate the prompt and efficient processing and = classification of=20 personnel in recruit training, COs of recruit training centers are = authorized to=20 disenroll and cancel NAVPERS 1070/621 and/or NAVPERS 1070/622 for = personnel=20 enlisted NF/AEF/ATF under certain circumstances without gaining prior = approval=20 of NAVPERSCOM (PERS-811). =20 Disenrollment or cancellation of extension agreement for any = reason other=20 than those listed below must be approved by NAVPERSCOM = (PERS-811):

 

           =20 (a) Failure to meet program qualifying test scores.

 

           =20 (b) Failure to pass the Farnsworth Lantern Examination for color=20 perception, failure to meet psychiatric standards, or suicide attempts = or=20 gestures; other potentially disqualifying physical defects will be = processed per=20 program instructions.

 

           =20 (c) Identification as a drug abuser.

 

           =20 (d) Inability to qualify for a security clearance without = extended=20 observation of the member=92s performance and behavior.

 

        = (2)=20 To facilitate the prompt and efficient processing of personnel attending = service=20 schools, COs of service school commands are authorized to cancel NAVPERS = 1070/621 and/or active duty agreement for personnel disenrolled from = NF/AEF/ATF=20 when all the following circumstances exist:

 

           =20 (a) Disenrollment has been approved by NAVPERSCOM, Distribution=20 Management and Procedures Branch (PERS-451) when required.

 

           =20 (b) Member has not accepted accelerated advancement.

 

           =20 (c) Member has not entered advanced = training.

 

    f. =20 Payback for 6-Year = Obligor=20 Programs during Advanced Training. =20 If a member is disenrolled for any reason from the advanced = training=20 phase of a 6‑Year Obligor Program after executing an extension of = enlistment or=20 active duty agreement to qualify for the course but has not accepted an=20 accelerated advancement, payback for instruction received will be = computed per=20 the table in paragraph 10j below. =20 The OBLISERV requirement for a member disenrolled from the = advanced=20 training phase subsequent to accepting an accelerated advancement will = not be=20 adjusted except as provided in the exemption above.  A member will not be = discontinued=20 at the member=92s own request after enrollment in the advanced phase of = a 6-Year=20 Obligor Program.

 

    g.  Payback for Incomplete Advanced = Training in=20 6‑Year Obligor Programs

 

        = (1)=20 A member in the NF/AEF/ATF 6‑Year Obligor Program, who = accepted=20 accelerated advancement on or after 1 September 1974, and who did = not=20 complete advanced training may be eligible for a reduction in their = 2-year=20 extension of up to a year.  = The=20 revision to the accelerated advancement program in August 1974 requires = a 5-year=20 obligation for personnel not in the NF/AEF/ATF Programs who accept = accelerated=20 advancement.  Consistent = with this=20 revision, personnel in the NF/AEF/ATF Programs who accepted accelerated=20 advancement on or after 1 September 1974 are obligated for 1 year = of their=20 2-year extension as a result of this accelerated advancement.  The remaining year of the = 2-year=20 extension is payback for the advanced training and if the advanced = training is=20 not completed, members may be eligible for a reduction in this 1-year=20 extension.  Members in the = NF/AEF/ATF Programs who accepted accelerated advancement prior to 1 = September=20 1974 are obligated for the full 2-year extension period regardless of = the amount=20 of advanced training received.

 

        = (2)=20 To facilitate the prompt and efficient processing of personnel attending = service=20 schools, COs of service school commands are authorized to cancel = Agreement to=20 Extend Enlistment and/or Active Duty agreement for personnel disenrolled = after=20 commencing advanced training from NF/AEF/ATF under the following=20 circumstances:

 

           =20 (a) Disenrollment has been approved by NAVPERSCOM (PERS-451) when = required.

 

           =20 (b) Member has executed an extension agreement for accelerated=20 advancement, if received, and required payback computed under this=20 article.

 

    h.  Disenrollments

 

        = (1)=20 COs will make sure that prospective enrollees in the advanced training = phases of=20 the NF/AEF/ATF programs understand the additional service requirements = incurred=20 and the required payback, if disenrolled. =20 In those cases in which payback is required, the member will be=20 permitted, upon approval of NAVPERSCOM (PERS-811), to execute a new = Agreement to=20 Extend Enlistment and/or Active Duty for a period that will provide the = payback=20 required for the number of weeks of training received per the table in = this=20 article.  The payback for=20 instruction received (when combined with the 1-year extension for = accelerated=20 advancement, if appropriate) cannot exceed the number of months of the = original=20 extension agreement.

 

        = (2)=20 If a member is disenrolled from the 5-Year Obligor Program for any = reason prior=20 to entry into the basic training phase, a request may be sent to = NAVPERSCOM=20 (PERS-811) for cancellation of an Agreement to Extend Enlistment and/or = Active=20 Duty.  A member failing to = complete=20 the Class =93A=94 school will be permitted, upon approval of NAVPERSCOM = (PERS-811)=20 to execute a new NAVPERS 1070/621, for a period that will provide the = payback=20 required for the number of weeks of training received per the table in = this=20 article.  Upon execution = of such an=20 extension, the previously executed extension agreement for the course of = instruction will be cancelled.  = The=20 payback for instruction received cannot exceed the number of months of = the=20 original extension agreement.

 

    i.  Definition of Instruction=20 Received

 

        = (1)=20 For regular students, it is a number of weeks of training actually=20 completed.

 

        = (2)=20 For accelerated students, it is the number of weeks of classroom seat = time=20 actually used at the time of disenrollment.

 

        = (3)=20 For repeat, held-over, or temporarily disenrolled students, it is the = number of=20 syllabus weeks actually completed in the course, exclusive of the number = of=20 weeks repeated, held over or temporarily disenrolled.

 

        = (4)=20 Partial weeks are not counted as weeks of instruction=20 received.

 

    j.  Payback Computation = Table.  For members in the NF/AEF/ATF = Program=20 disenrolled from advanced training, the months of service obligation to = be=20 incurred in return for cancellation of a previous extension executed for = training (payback) is computed in the table below.  If the table shows a = requirement to=20 serve a greater number of months than the original extension or if the = number of=20 months from the table when combined with extension incurred as the = result of=20 accepting accelerated advancement (6-YO Programs only) is greater than = the=20 original extension, then the original extension remains in = effect.
